1. Introduction

These Terms and Conditions (“Terms”) govern your use of the website shop.theninevites.com (the “Site”) and any purchase you make through it. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms should be read together with our Privacy Policy and our Refund and Returns Policy, both of which form part of your agreement with us.

2. Who We Are

The Site is operated by The Ninevites, a design studio specialising in handwoven textiles, based at:

References to “we”, “us” or “our” mean The Ninevites. References to “you” or “your” mean the person using the Site or placing an order.

3. Products

3.1 We sell handwoven rugs, blankets, wall hangings, cushion covers, and related textile products, as described on the Site.

3.2 Because our products are handcrafted, slight variations in colour, pattern placement, texture, size, and fringing between the product photographs and the item you receive are normal and expected, and do not constitute a fault or defect. We try to represent each piece as accurately as possible in product photography and descriptions.

3.3 We make reasonable efforts to display colours and sizes accurately, but we cannot guarantee that your device’s display will reflect the true colour of the product.

3.4 We reserve the right to limit the quantity of any product ordered and to discontinue any product at any time.

4. Prices and Payment

4.1 All prices on the Site are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable, unless stated otherwise.

4.2 We reserve the right to change prices at any time, but changes will not affect orders we have already confirmed.

4.3 Payment is processed securely through the payment methods displayed at checkout. We do not store your full card details; these are handled directly by our payment gateway provider.

4.4 We reserve the right to refuse or cancel an order if we suspect fraud, error in pricing or stock, or any breach of these Terms, and will notify you and refund any payment already made.

5. Orders

5.1 Placing an order through the Site is an offer to purchase, which we may accept or decline. A contract between us is only formed once we send you an order confirmation by email.

5.2 We may decline an order where a product is out of stock, where there has been a pricing or listing error, or where we are unable to verify your payment or shipping details.

5.3 For made-to-order or commissioned pieces, the specifications, lead time, and price will be confirmed with you in writing (by email) before production begins, and that confirmation forms part of your contract with us for that item.

6. Delivery

6.1 Delivery timeframes, costs, and methods are set out in our Shipping Policy. Estimated delivery times are not guaranteed and may vary due to courier delays, stock availability, or production time for made-to-order items.

6.2 Risk in the products passes to you once they are delivered to the address you provided at checkout. Please ensure your delivery details are correct, as we are not responsible for orders delayed or lost due to incorrect address information supplied by you.

7. Right to Cancel (Cooling-Off Period)

7.1 In line with the Electronic Communications and Transactions Act 25 of 2002, where you purchase a ready-made (stock) item through the Site, you may cancel that transaction without reason or penalty within seven (7) calendar days of receiving the goods, provided the item is unused and returned in its original condition and packaging. You will be responsible for the direct cost of returning the goods unless they are faulty.

7.2 This right to cancel does not apply to goods made to your specification or clearly personalised — including custom or commissioned rugs, blankets, or other pieces made to your chosen size, colourway, or design — as these are excluded under the Act.

8. Returns, Refunds and Exchanges

Full detail on faulty items, exchanges, and our return process is set out in our Refund and Returns Policy. Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 to a repair, replacement, or refund where goods fail to meet the implied warranty of quality, which applies for six months from delivery.

9. Intellectual Property

9.1 All designs, patterns, photography, text, and other content on the Site are the property of The Ninevites or our artisan partners and are protected by copyright and other intellectual property laws.

9.2 You may not reproduce, copy, adapt, or commercially exploit any design, pattern, or content from the Site without our prior written consent.

10. Acceptable Use

You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorised access to our systems, to interfere with the Site’s operation, or to submit false or fraudulent orders.

11. Limitation of Liability

11.1 To the extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Site or your purchase of a product, including loss of income or opportunity.

11.2 Our total liability to you for any claim relating to an order is limited to the amount you paid for the relevant product.

11.3 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or any other applicable law.

12. Indemnity

You agree to indemnify and hold The Ninevites harmless against any claim, loss, or damage arising from your breach of these Terms or your misuse of the Site.

13. Privacy

Our collection and use of your personal information is described in our Privacy Policy, which complies with the Protection of Personal Information Act 4 of 2013 (POPIA).

14. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time of your order will apply to that order. We recommend checking this page periodically.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and any dispute will be subject to the jurisdiction of the South African courts.
